These Terms of Service govern the use of Imagibo and the purchase of digital and, where available, printed personalised products through the website.

If you do not agree with these terms, you must not use the service.

1. Service scope

Imagibo provides tools to create personalised children's stories and illustrations with the help of AI systems and human-reviewed workflows.

Certain features may require an account, payment confirmation, approval of generated content or additional production time.

2. Eligibility and account

  • You must be at least 18 years old and have legal capacity to contract.
  • You are responsible for keeping your credentials secure and for all activity carried out through your account.
  • You must provide truthful information and update it when it changes.

3. Acceptable use

  • Do not use the service for unlawful, abusive, discriminatory, defamatory or infringing content.
  • Do not submit content that violates intellectual property, privacy, image rights or the rights of children or third parties.
  • Do not use bots, scraping tools, reverse engineering or security circumvention techniques against the website or platform.

4. AI outputs and user responsibility

AI-generated outputs are creative and may contain inaccuracies or unexpected results. You are responsible for reviewing the content before approving it, sharing it or ordering a printed edition.

You remain responsible for the personal data and materials you upload or submit. You confirm that you have the rights and permissions needed to use them.

5. Pricing and payments

Prices are shown in euros unless stated otherwise and will include applicable taxes unless the website says otherwise.

Payments are processed through authorised providers such as Stripe. Imagibo does not store full payment card details.

Imagibo may suspend delivery, account access to paid features or order processing if payment is rejected, reversed or suspected to be fraudulent.

6. Delivery, cancellation and withdrawal

If you are a consumer in the European Union, you generally have a fourteen-day withdrawal period for distance contracts.

However, the withdrawal right does not apply once the digital service has started at your prior express request and after you acknowledged that you would lose that right.

The withdrawal right also does not apply to clearly personalised printed goods once production has started.

If a refund is due, it will be made using the original payment method unless another lawful solution is agreed.

7. Intellectual property and licences

Imagibo retains all rights over the platform, software, workflows, branding and website materials.

You retain ownership over the content you provide. You grant Imagibo a limited, non-exclusive licence to use that content only to operate, secure, improve and deliver the service requested by you.

8. Availability, modifications and suspension

Imagibo may update, improve, suspend or discontinue parts of the service for technical, legal, security or business reasons.

Imagibo may suspend or terminate accounts that breach these Terms, applicable law or the rights of third parties.

9. Liability

Imagibo will be liable only for damages directly caused by wilful misconduct or gross negligence, and in all cases subject to mandatory consumer law.

To the maximum extent permitted by law, Imagibo will not be liable for indirect damages, loss of profit, user-input errors, force majeure or third-party outages beyond its control.

10. Complaints, ADR and governing law

These Terms are governed by Spanish law, without prejudice to mandatory consumer-protection rules that may apply in your country of residence.

Before going to court, the parties should try in good faith to resolve any dispute by contacting hello@imagibo.com.

Consumers may consult the European Commission ADR list for information about available alternative dispute resolution bodies. The former EU Online Dispute Resolution platform is no longer active.

If no amicable solution is reached, disputes will be submitted to the competent courts in accordance with applicable law.
